Job Summary

Reporting to the General Counsel, the Legal Counsel manages and supports the provision of legal services, investigation of claims and defenses, contract negotiations and ensures legal compliance with the Authority’s Charter and Mandates. This role is primarily responsible for supporting the General Counsel in the Legal Affairs function for WDBA’s mandate. In addition, this position will remain apprised of the management of US properties, corporate procurement and WDBA’s insurance program related to the project in order to provide assistance and/or coverage on these files.

Overview of Responsibilities

 Provides expert advice and helps manage complex legal matters surrounding major infrastructure procurement projects. Negotiates and drafts contracts and agreements, consults and advises on the administration of construction projects, evaluates other disputes, as needed.

 Liaises with external counsel/outsourced legal agencies where appropriate for commercial transactions. Maintains relations with the legal community and external stakeholders, fostering an effective exchange of information and representing the best interests of the Authority.

 This position will handle the assessment and resolution of claims on construction contracts. This includes assessing the merits, validity or principle of claims and determine the fair and reasonable quantum of the claim, as well as strategies employed in order to handle the claims.

 Remains apprised of the management, analysis and administration of WDBA’s insurance program related to the project, including the management of claims and property damage events. Remain apprised of and assist as needed with the management of corporate procurement ensuring an uninterrupted supply at optimal cost, in accordance with procurement strategies, policies and guidelines, including reporting on projects, etc.

 Assist with the oversight of the US Property Acquisition team in the completion of various condemnation and other land acquisition cases.

 Provide input to the department’s budget. Meet with General Counsel and Finance to support quarterly budget process, and annual planning. Collaborates with legal team to develop content for the Annual Report and Corporate Plan.

Competencies and Qualifications

 Law degree from a recognized university.

 Membership in good standing in a Law Society of a province or territory of Canada

 Minimum of 7 years’ legal experience.

 Demonstrated experience in an area (or wide variety of areas) of complex legal practice.

 Experience leading multidisciplinary teams.

 Experience in transactional law an asset.

 In-depth knowledge of the culture of the Public Service of Canada, the legislative framework of WDBA’s governance infrastructure.

 In-depth knowledge of the public service sector, private sector and knowledge of P3.

 Intermediate MS Office skills.

 Ability to build consensus and drive outcomes with diverse stakeholders.

 Strong ability to communicate effectively orally and in writing while ensuring tact and diplomacy.

 Sound professional judgement, initiative and the ability to work well under pressure and manage multiple priorities to meet deadlines.  Ability to problem solve and make decisions, and do so with a strong attention to detail.

 Must maintain strong political awareness, judgment and sensitivity, must have the ability to influence others and maintain strong relationships.

 Well-rounded knowledge of relationship management and client satisfaction.

 Demonstrated ability to effectively lead, direct, motivate and mentor staff.

Total Compensation

 Salary $127,362 to $155,664
