Deputy City Solicitor, Litigation

The Deputy City Solicitor, Litigation, manages and directs the lawyers, law clerks and legal assistants in the Litigation Section and directs external counsel as required.  A member of the Legal Management Team, reporting to the City Solicitor, the successful candidate is a people leader who engages in business planning and strategic planning, embraces new legal technologies and will manage change within Legal Services and across the corporation.  The Deputy City Solicitor provides legal advice to City staff and Council, attends Council and Committee meetings, represents the City before the courts and tribunals and conducts training on risk and liability issues.

Duties and Responsibilities
  • maintains a caseload, providing legal advice and representation on litigation and administrative law matters
  • supervises and empowers lawyers and legal professionals in the Litigation Section and provides oversight of tort actions,  construction delay and lien claims, breach of contract and warranty claims, collection actions, tax assessment appeals and general commercial litigation
  • responsible for recruitment and development of talent in the Litigation Section, including conducting performance evaluations
  • ensures an equitable and effective distribution of caseload to lawyers in the Section and retains and directs external counsel where appropriate
  • sits on the Legal Management Team and participates in strategic and business planning; develops and reports on performance measures and metrics
  • responsible for implementing new legal document management software and leading change to adopt a paperless legal practice 
  • contributes to a positive and respectful workplace and organizational culture that is consistent with corporate values and supports the strategic plans of the City and Legal Services
  • promotes collaboration and teamwork across the Section and the corporation
  • provides legal advice and opinions on a broad range of issues, including risk and liability matters, and prepares reports to Council and its Committees
  • attends public meetings to present the City's position/actions to the public, media and/or outside government bodies
  • participates on behalf of the City on policy and advocacy matters for the City, AMO or FCM as requested by the City Solicitor or City Manager
  • represents the City in the courts, before tribunals, on examinations for discovery and at mediation
  • acts as first point of contact for matters directed to the Section and assumes responsibility for other matters delegated by the City Solicitor
  • performs other duties as assigned
Skills and Qualifications
  •  post-graduate university degree in law (LL.B. or JD) and a member in good standing of the Law Society of Ontario
  • a minimum of 10 years of progressive litigation and advocacy experience before courts and tribunals gained in insurance defence/personal injury, commercial litigation, construction and/or administrative law matters.  Experience conducting trials or administrative hearings as lead counsel is an asset.
  • strong oral and written advocacy and negotiation skills
  • experience in leading and directing teams, including leading change within an organization
  • committment to process improvement and law department modernization with demonstrated knowledge of legal technologies and legal case management principles
  • excellent interpersonal and communication skills with a demonstrated ability to effectively interact with Council, staff at all levels and members of the public
  • analytical and strategic thinker who provides solid legal advice and demonstrates business and political acumen
  • financial literacy and experience with budgets an asset
  • previous experience in municipal government is an asset
  • experience with e-discovery, paperless litigation files and legal case management software
